By using this website, reading its blog, accessing the newsletter you subscribed to, or any associated services from Andy Fenske, you agree to these Terms of Use included hereunder.

By using this website, reading its blog, accessing the newsletter you subscribed to, or any associated services from Andy Fenske, you agree to these Terms of Use included herein (the "Terms of Use" ot the “Terms”). The Terms of Use constitute the entire agreement between you, the subscriber or user and Andy Fenske. No other terms, verbal or written, will be applicable.

These Terms of Use are independent of and do not replace Substack’s Terms of Service, which apply separately to your use of the Substack platform.

Andy Fenske and Andreas Fenske Coaching do not endorse, control, or assume any responsibility for the accuracy, legality, or content of external websites, services, or platforms linked from this publication. 3. No Professional Advice or Guarantees

All content provided by Andy Fenske, including, without limitation, blog articles, coaching insights, videos, podcasts, AI tools, legal templates, guides, digital products, and any other resources and services (the “Content”), is for informational and artistic expression purposes only.

Using a template does not create an attorney-client relationship between you and Andy Fenske or Andreas Fenske Coaching. You should Coaching a qualified attorney in your jurisdiction, before relying on any Content, especially template or AI Agent.

By purchasing or downloading a template, or using the AI agents created by Andy Fenske you receive a limited, non-exclusive, non-transferable license to use it for your personal or internal business purposes only. You may not sell, distribute, or modify the templates for commercial purposes. Andy Fenske disclaims all liability related to the use of templates, and all sales are final, except as required by law.

5. Exclusion of Coaching Services

Coaching services do not form part of a Substack subscription package. Coaching services are provided under specific coaching terms. You will find the coaching terms listed in the booking link, and you will be asked to agree to them before you can book your session(s). No liability relating to coaching services shall be applicable under these terms.

6. Disclaimer of Liability and Liability Cap

To the fullest extent permitted by law, Andy Fenske, and Andreas Fenske Coaching disclaim all liability for any direct, indirect, incidental, consequential, punitive, or special damages arising from your use of the Content offered via Andy Fenske.

No Warranties: To the maximum extent permitted by applicable law, Content is provided “as is” and “as available,” and is provided without express or implied warranties of suitability, accuracy, completeness, enforceability, legal compliance, suitability for any particular jurisdiction, correctness, non-infringement, non-reliance, reaching any specific results, merchantability, no duty to update is offered, and any other implied warranties that may be applicable if not excluded.

Limited Liability: In no event shall Andy Fenske, or Andy Fenske Coaching be liable for damages related to:

• Your use of or reliance on Andy Fenske Content.

• Errors, omissions, or inaccuracies in any Content, including legal templates and AI-generated materials.

• Security breaches, data loss, unauthorized access, or platform failures.

• Third-party claims arising from your use of Andy Fenske Content.

Liability Cap: If liability is found, it shall not exceed the total fees paid by the claimant in the three (3) months preceding the event. If no fees were paid, Andy Fenske shall have no liability whatsoever.

Andy Fenske shall not be liable for any claims, legal disputes, or damages brought against you by third parties as a result of using its Content.

No Guarantee of Continued Access to Content

Subscribing to Andy Fenske does not guarantee that any specific type of Content will continue to be provided indefinitely. Andy Fenske reserves the right to modify, discontinue, or replace any Content, including but not limited to articles, newsletters, podcasts, legal templates, AI-generated materials, or other digital resources, at our sole discretion without prior notice.

Force Majeure: Andy Fenske shall not be responsible for any failures, delays, or damages resulting from events beyond its reasonable control, including but not limited to cyberattacks, platform failures, government actions, acts of nature, or other force majeure events.

For the avoidance of doubt, the disclaimers in this section 6 expressly apply to the use of any Content but especially the legal templates, AI-generated content, and any digital resources as described in Section 4.

7. Refunds & Chargeback Policy

All sales are final. No refunds, exchanges, or credits will be provided for:

• Subscriptions to Andy Fenske, including newsletter access and digital content.

• Legal templates, AI-generated content, digital guides, and courses.

• One-time digital purchases or downloadable content.

• Any other digital products or services offered by Andy Fenske, except where required by applicable law.

No Trial Periods or Partial Refunds: Andy Fenske does not offer trial periods or partial refunds for unused portions of a subscription, digital product, or service. Once a purchase is made, it is non-refundable.

Chargebacks & Payment Disputes: By purchasing from Andy Fenske, you agree to waive your right to dispute charges with your bank or payment provider. If a chargeback is initiated, we reserve the right to:

• Block access to all Content and services.

• Pursue collection actions, including legal remedies, to recover the disputed amount.

• Report fraudulent chargebacks to payment processors and relevant authorities.

Coaching & Service-Based Refunds: Coaching services are covered under separate terms, and refunds (if any) are governed by those terms. Any coaching refunds must be reviewed under the separate coaching agreement.

8. Intellectual Property Rights & Limited License

Ownership & Copyright: All Content published on Andy Fenske, including but not limited to articles, newsletters, videos, podcasts, coaching materials, templates, guides, courses, AI-generated content, AI tools/agents, and any related resources, is the exclusive property of Andy Fenske and Andreas  Fenske Coaching, unless otherwise stated. All rights are reserved.

Limited License for Personal & Internal Business Use: By accessing Andy Fenske, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal use or for internal business use within your wholly owned company. This does not grant permission to modify, republish, or distribute Content for commercial purposes or client-facing work.

Prohibited Uses: You may not:

• Copy, modify, distribute, sell, sublicense, or create derivative works of the Content without prior written permission.

• Remove, alter, or obscure copyright notices or proprietary rights statements.

• Train, embed, or integrate the Content into AI models, machine learning systems, or automated tools.

• Use automated bots, crawlers, or scrapers to access or copy Content from Andy Fenske.

• Prohibited Commercial Use. You may not use Andy Fenske Content to create, market, or distribute competing products or services, including but not limited to legal templates, AI tools, coaching materials, or digital guides, without prior written permission.

These Terms of Use shall be governed by and construed in accordance with the laws of Denmark. Any disputes arising out of or related to these Terms of Use shall be subject to the exclusive jurisdiction of the courts of Malmö, Sweden.

Any claim or cause of action arising out of or related to these Terms or your use of Andy Fenske must be filed within one (1) year after such claim or cause of action arose. Otherwise, the claim is permanently barred unless applicable law permits it.

11. Variation of Terms

Andy Fenske reserves the right to modify, update, or replace these Terms of Use at any time at its sole discretion. Any changes will take effect immediately upon posting on Andy Fenske. Your continued use of the website, newsletter, or any associated services after updates constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to the updated Terms, you must discontinue use of Andy Fenske and its services.
